Introduction
These Terms & Conditions (“Terms”) govern the use of the PumpSafer platform, website, mobile application, training systems, inspection tools, and related services provided by PumpSafer Safety Management Ltd. (“PumpSafer”, “we”, “our”, or “us”). By accessing or using PumpSafer services, users agree to comply with these Terms.
1. About PumpSafer
PumpSafer is a system-based safety management platform developed for the concrete pumping industry. The platform is designed to support training, competency verification, inspection documentation, compliance support, and workplace safety management aligned with recognized industry standards, including Canadian Standards Association (CSA Z151) and American Society of Mechanical Engineers (ASME B30.27.)
2. Acceptance of Terms
By creating an account, accessing the platform, or using PumpSafer services, users acknowledge that they have read, understood, and agreed to these Terms & Conditions.
3. Intended Use
PumpSafer is intended for professional workplace use by employers, supervisors, operators, mechanics, trainers, inspectors, and authorized personnel involved in concrete pumping operations. Users agree to use the platform only for lawful and authorized purposes.
4. User Responsibilities
Users are responsible for:

Protecting account credentials and login access

Ensuring all uploaded information is accurate and lawful

Following applicable workplace safety regulations and manufacturer requirements

5. Training & Competency Disclaimer
PumpSafer provides training, competency assessment, inspection, and documentation tools intended to support workplace safety and due diligence processes.
PumpSafer does not guarantee regulatory compliance, certification, operator qualification, or workplace safety outcomes.
Employers, supervisors, operators, and equipment owners remain fully responsible for ensuring compliance with all applicable laws, regulations, standards, manufacturer requirements, and safe work practices.
6. Inspection & Compliance Documentation
Inspection forms, checklists, competency records, and compliance documentation generated through PumpSafer are intended as administrative and operational support tools.
Users are responsible for verifying the accuracy, completeness, and suitability of all inspections, records, and safety documentation.
Where required by law or regulation, inspections must still be performed by qualified persons, competent persons, engineers, mechanics, or other authorized individuals.
7. Intellectual Property
All PumpSafer content, including but not limited to course materials, assessments, inspection forms, logos, graphics, software, workflows, and written content, remain the intellectual property of PumpSafer Safety Management Ltd.
Users may not reproduce, distribute, modify, sell, or commercially exploit PumpSafer materials without written authorization.
8. Data & Privacy
Use of the PumpSafer platform is also governed by the PumpSafer Privacy Policy. Users acknowledge that certain information may be collected, stored, and processed as part of platform operations, including training records, competency assessments, inspection documentation, and user account information.
9. Platform Availability
PumpSafer strives to maintain reliable platform availability; however, uninterrupted access cannot be guaranteed.
PumpSafer may temporarily suspend access for maintenance, updates, security purposes, or operational improvements without prior notice.
10. Limitation of Liability
To the fullest extent permitted by law, PumpSafer Safety Management Ltd., its directors, employees, contractors, affiliates, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

Reliance on training or inspection materials

Inaccurate or incomplete records

Equipment failures or workplace incidents

Regulatory enforcement actions

Loss of data, profits, or business opportunities
Users assume full responsibility for workplace decisions, operational safety, and regulatory compliance.
11. Third-Party Services
PumpSafer may utilize third-party services, hosting providers, integrations, analytics services, and communication tools to support platform functionality.
PumpSafer is not responsible for the performance or privacy practices of independent
third-party services.
12. Account Suspension or Termination
PumpSafer reserves the right to suspend or terminate user accounts that:

Upload false, fraudulent, or unlawful information

Interfere with platform operations or security
13. Modifications to Terms
PumpSafer may update or revise these Terms & Conditions periodically.
Updated versions will be posted with a revised effective date. Continued use of the platform constitutes acceptance of revised Terms.
14. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable laws of Canada.
